Against the Machine: A Single Mother's Desperate Fight for Justice and the Dashcam That Proved It All
Chapter 13: The Discovery Motion
Judge Halloway looked like he’d rather be on the golf course than listening to Marcus Thorne argue about discovery protocols. The courtroom was empty, save for the bailiff, Elena, and Silas Vane, who looked bored as he checked his luxury watch.
"Your Honor," Marcus said, his voice echoing in the chamber. "The defense is engaging in spoliation of evidence. They destroyed the truck. Now they are refusing to hand over the maintenance logs. We are filing a motion to compel immediately."
Silas stood up, buttoning his jacket. "Objection, Your Honor. This is a fishing expedition. Mr. Thorne is wasting the court's time and resources. Omni-Haul has thousands of trucks. Producing physical logs for the entire fleet is an undue administrative burden."
"I don't want the fleet," Marcus snapped. "I want the logs for Unit 404. The truck that nearly killed my client."
Judge Halloway sighed, rubbing his temples. He and Silas were members of the same country club; Marcus knew that. The bias was palpable.
"Mr. Thorne," the Judge said heavily. "I am inclined to agree with Mr. Vane. However, for the sake of thoroughness..." He paused, looking at the clock.
"I will grant your motion. You have access to the specific maintenance records for Unit 404. But you have twenty-four hours to find actionable evidence. If you don't file a specific cause of action by 5:00 PM tomorrow, I’m dismissing this case with prejudice."
Marcus felt the blood drain from his face. Twenty-four hours to sift through years of data. It was a trap.
